Terms of Service

1. Provider

gymbro™ is operated by Bastian Wiede, WI-IM-EX, c/o IP-Management #4150, Ludwig-Erhard-Str. 18, 20459 Hamburg, Germany ("we", "us").

2. Service

gymbro is a fitness challenge service that counts pushups using on-device camera pose detection and ranks results on a global leaderboard. The service is provided "as is" without warranties of any kind.

3. Eligibility & health disclaimer

You must be at least 16 years old (or the age of digital consent in your jurisdiction) to use gymbro. Physical exercise carries risk. Consult a physician before starting any fitness program. You use gymbro at your own risk and are solely responsible for your safety.

4. Account & conduct

  • You are responsible for keeping your credentials confidential.
  • Don't submit fraudulent scores, manipulate the tracker, or abuse the service.
  • Don't harass other users, post unlawful content, or attempt to gain unauthorised access.

We may suspend or terminate accounts that violate these terms.

5. Intellectual property

All content, branding, and trademarks (including "gymbro™") are owned by WI-IM-EX or its licensors. You may not copy, reproduce, or commercially exploit the service without written permission.

6. User content

By submitting scores or a username, you grant us a non-exclusive, worldwide, royalty-free licence to display them on the leaderboard.

7. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from your use of the service. Mandatory statutory liability (e.g. for intent and gross negligence) is unaffected.

8. Termination

You may delete your account at any time from your profile. We may terminate or suspend access for breach of these terms.

9. Governing law & jurisdiction

These terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protections of your country of residence remain unaffected. Place of jurisdiction is Hamburg, Germany, where permitted by law.

10. EU online dispute resolution

The European Commission provides a platform for online dispute resolution at ec.europa.eu/consumers/odr. We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.

11. Changes

We may update these terms. Continued use after changes constitutes acceptance of the revised terms.
